What these terms cover
Effective date: November 4, 2026.
These terms are between you and Ezbre LLC (“Ezbre”, “we”, “us”), 1217 South Greeley Highway, Suite B, Cheyenne, WY 82007. They have two parts. The first covers your use of this website, ezbre.com. The second is a plain summary of how our service terms work for clients.
If you are a client, your signed order governs. The signed order, and any terms it refers to, sets out exactly what we provide, at what price and on what conditions. If anything on this page differs from your signed order, the signed order wins.
Using this website
By using this website, you agree to these website terms. If you do not agree, please do not use it.
- Information, not advice. Our pages, articles and tools are general information about backup and recovery. They are not legal, compliance, tax or insurance advice. Ask your counsel or compliance owner about your own duties.
- Tools give estimates. The downtime cost calculator and the readiness check work only from what you enter. Their results are estimates for your own planning, not a quote or an assessment by us.
- Prices are indicative. Prices on this website are indicative “from” prices and exclude sales tax. A written quote or a signed order sets the price you pay.
- Our content. The text, illustrations and design of this website belong to Ezbre LLC. You may read, print and share pages for your own business use. Please do not republish them without our written permission.
- Fair use of the site. Do not try to break into, overload or disrupt the website, send malicious code, or use the forms to send spam or to write on someone else’s behalf.
- Other websites. We link to other sites, such as CISA and Microsoft, for reference. We do not control them and are not responsible for their content.
We provide this website “as is”. We work to keep it accurate and available, but we do not promise that it always will be.
The service terms, in brief
The sections below summarize our standard service terms. They are a guide to what you will sign, not a substitute for it.
- The signed order governs. It lists your plans, quantities, prices and any settings that differ from our defaults, such as retention periods.
- Month to month. Monthly plans run month to month. Either side can end a plan with 30 days’ written notice, and email counts as written notice.
- Billing. One-off projects, such as a Recovery Runbook, are fixed-fee and quoted in writing before work starts. Monthly plans for 5 or more devices or users have no setup fee. Prices exclude sales tax.
Leaving, export and deletion
When a plan ends, we hand over a full export of your data in standard formats at no charge. We delete our copies 30 days after you confirm the export, and we confirm the deletion in writing.
Immutable copies cannot be deleted by anyone, including us, until their lock ends. A copy still under a lock is deleted when its lock ends, which is 30 days by default.
Restore targets are targets
We publish restore targets and measure them in every Restore Drill:
- a single file or mailbox item within 1 business hour of your request
- a full workstation within 1 business day
- a server started as a cloud virtual machine within 4 hours, on Standby Recovery
These are targets, not guarantees. A restore can take longer because of the amount of data, the state of your hardware or network, or the cause of the failure. We can restore only what was backed up: data created after the last good copy, or held on a device that was offline or left out, may not be recoverable.
If we miss a target, we tell you why in writing. Missing a target is not by itself a breach of the service terms, unless your signed order says otherwise.
What we ask of you
The service depends on your help. You agree to:
- keep devices switched on and connected often enough to back up, since workstations copy only while online
- leave our agent installed and running, and tell us before you replace or retire a device or server
- give, and keep in place, the admin consent we need to back up Microsoft 365 or Google Workspace
- tell us about new systems, offices and staff changes that affect what we back up
- keep your admin passwords safe, and keep your encryption key safe if you hold it yourself, because without it nobody can restore your data
- make sure you have the right to give us the data you ask us to back up, and decide with your counsel which rules apply to it
- send restore requests to support@ezbre.com; on Server Backup and Standby Recovery, put “URGENT” in the subject after hours
What the service is not for
You may not use the service to:
- store or restore data you have no right to hold
- store unlawful content, or upload malicious code on purpose
- try to reach other clients’ data, test our security without our written permission, or disrupt our systems
- resell the service to others without a written agreement with us
Backups can contain malicious code that was already on a system when we copied it. That is not a breach of these terms, and recovering from it is part of the work.
If a use breaks these rules, we will tell you why before we suspend the affected service, unless the risk to other clients or our systems requires us to act at once. We will work with you to put it right before we end anything.
Limits on liability
We do our work with reasonable skill and care. Beyond what these terms and your signed order say, we make no other promises about the service, including that any particular data can be recovered.
Ezbre’s total liability for all claims arising from the service is limited to the fees you paid Ezbre in the 3 months before the event that led to the claim. Neither side is liable to the other for indirect or consequential losses, such as lost profits or lost business.
These limits do not apply where the law does not allow them to be limited.
Wyoming law and courts
Wyoming law governs these terms and our service terms, without regard to its conflict-of-laws rules. Any dispute goes to the state or federal courts located in Laramie County, Wyoming, and both sides agree to those courts’ jurisdiction.
Before going to court, please email mail@ezbre.com so that we can try to settle the matter directly.
Changes to these terms
We may update the website terms by posting a new version on this page with a new effective date. A change to the service terms applies to an existing client only 30 days after we email the client about it, which leaves time to end the plan on the usual notice if the client does not agree.
